Season Beta Terms of Participation

Version 1.0, as of October 2026. This is a convenience translation. In case of any discrepancy, the German version prevails.

These terms apply to your free participation in the Big Beta of the Season app. They become binding once you actively accept them during sign-up. How we handle your data is explained in the separate Season Beta Privacy Notice.

§ 1 Scope and contracting party

1.1 These Terms of Participation govern your participation in the beta testing phase of the Season app (“Beta”). Your contracting party is Season UG (haftungsbeschränkt), Am Bruxbaum 4a, 41748 Viersen, Germany, represented by its managing directors Shanel Chien and Celine Enda Ndakwa, email: shanel@season.vision (“Season” or “we”).

1.2 Only these Terms of Participation apply to the Beta. The general Terms of Use of the Season app apply only from the official launch and only if you accept them separately at that time.

1.3 The following also apply:

  • the Season Beta Privacy Notice, which explains how we handle your data,
  • the terms of Apple (TestFlight) or Google (Google Play) if you install the Beta through these platforms. Apple and Google are not our contracting parties for the Beta and are not responsible for the app.

1.4 The Beta is intended for consumers who use Season for private purposes.

§ 2 Who can participate

2.1 You must be at least 18 years old. By accepting these terms, you confirm that this is the case.

2.2 One account per person is allowed. Your account and your Beta access cannot be transferred.

2.3 Places in the Beta are limited. There is no right to participate. We select testers at our own discretion, for example in order of sign-up or to build a diverse test group.

2.4 Participation is voluntary and free of charge. You can end it at any time without giving reasons (see § 9).

§ 3 What the Beta is

3.1 The Beta is a test version of the Season app before the official launch. The goal is to test and improve the app together with you.

3.2 Access: via Apple TestFlight (iOS), via the Google Play testing program (Android) or in your browser via our web app. With one account you can switch between phone and browser.

3.3 Features: In the Beta you can track your cycle and entries such as period, discharge, mood, symptoms, sleep and body temperature, plan appointments in your cycle calendar, connect your Google or iCloud calendar and see a forecast of your cycle phases, including an estimated ovulation. Premium features that we unlock for the Beta are free of charge.

3.4 Because this is a test version: features may be incomplete, contain bugs, change at short notice, be temporarily unavailable or be removed. The forecast is an estimate and may be inaccurate, especially at the beginning and with irregular cycles. In rare cases, entries may be lost. Please do not keep important information, for example for medical appointments, only in Season.

3.5 Costs: The Beta is free of charge. There is no right to continued free use after the Beta ends. The Beta does not automatically turn into a paid subscription; a subscription only exists if you actively take one out later.

§ 4 Not a medical device, not for contraception

4.1 Season is not a medical device. Content, cycle phases, the forecast and all tips on exercise, nutrition and wellbeing are for general information and planning purposes.

4.2 Season does not make diagnoses, does not provide medical advice and does not replace medical or therapeutic treatment.

4.3 Season is not suitable for contraception and is not intended to plan or prevent a pregnancy. Information and notifications about cycle phases, ovulation or possible fertile days are estimates.

4.4 Tips on exercise and nutrition are general. If you are pregnant, have pre-existing conditions or take medication, please discuss changes with your doctor first.

4.5 If you have symptoms or concerns, contact a medical professional. In an emergency, call 112.

§ 5 Your account

5.1 You need an account for the Beta. You register with your email address and a password or via your Apple, Google or Facebook account.

5.2 Keep your password secret and use one you do not use anywhere else. We also recommend a screen lock on your device. If you suspect that someone has unauthorised access to your account, please contact us immediately.

5.3 You decide which cycle and health information you enter. The more you enter, the more accurate the forecast can become.

5.4 Please do not enter sensitive information about other people in notes or calendar entries, for example as guests, unless necessary.

§ 6 Feedback

6.1 Your feedback is at the heart of the Beta. You can send it to us via the feedback function in the app, by email or via the feedback function of TestFlight or Google Play. Feedback is voluntary. There is no right to have suggestions implemented.

6.2 You grant us a free, non-exclusive right, unlimited in time and territory, to use your feedback (suggestions, ideas, bug reports) to improve and develop Season.

6.3 We will not publish your feedback under your name or use it as a quote or testimonial without asking you separately first.

6.4 Screenshots you send us may show health data. Please only send screenshots you are comfortable sharing. Feedback you send via TestFlight or Google Play is also processed by Apple or Google.

6.5 If you have agreed, we will invite you by email to voluntary surveys or interviews. You can withdraw this consent at any time.

§ 7 Sharing on social media and confidentiality

7.1 You are welcome to talk and post about your experience with Season. Please make clear that it is a beta version that is not yet finished.

7.2 Please do not share publicly any features or content that we explicitly mark as confidential (for example, features not yet announced).

7.3 When sharing screenshots, keep in mind that they may show your own health data.

7.4 Please report security vulnerabilities or bugs that could affect other people’s data directly to us and not publicly, so that we can fix them quickly.

§ 8 Rights of use and rules

8.1 For the duration of the Beta, you receive a simple, non-transferable and revocable right to use the app for private purposes. All rights to the app, its content, texts, graphics and the Season brand remain with us or the respective rights holders.

8.2 In particular, you may not:

  • share your login details or your Beta access with others,
  • decompile, modify or recreate the app beyond what the law permits,
  • circumvent technical protection measures or extract data from the app automatically,
  • carry out attacks or security tests without our prior consent,
  • use the app or its content commercially,
  • enter unlawful content in notes, calendar entries or feedback.

8.3 If you break these rules, we may block or end your Beta access (see § 9.4).

§ 9 Duration, end of the Beta and your data afterwards

9.1 Your participation starts when we activate your access. The Beta ends at the latest with the official launch. We will inform you about the end in good time by email.

9.2 We may extend, shorten, pause or end the Beta. We will usually inform you by email at least 14 days in advance. For urgent reasons, for example to protect your data in the event of a security issue, we may also restrict access immediately.

9.3 You can leave at any time by deleting your account in the app under Settings > Account or by emailing shanel@season.vision. Uninstalling the app alone does not delete your account.

9.4 We may end your participation by email with 14 days’ notice, or immediately for good cause. Good cause exists in particular in the event of serious or repeated breaches of these terms.

9.5 Transfer to the live version: When Season officially launches, we will transfer your account and your entries to the live version so you do not have to start from scratch. We will inform you by email in advance. Use after the launch will then be governed by the Terms of Use and Privacy Policy of the live version, which we will present to you for acceptance.

9.6 If you do not want the transfer, you can delete your account at any time before or after the launch. If you do not accept the terms of the live version, we will delete your account and your entries.

§ 10 Liability

10.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and if we have fraudulently concealed a defect.

10.2 In the event of a slightly negligent breach of an essential obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential obligations are those whose fulfilment makes participation in the Beta possible in the first place and on whose compliance you may regularly rely, for example the careful handling of your data. Otherwise, we are not liable for slight negligence.

10.3 As the Beta is a free test version, we do not warrant that it is always available, works without errors or that the forecast is accurate.

10.4 These liability rules also apply to our employees, representatives and vicarious agents.

10.5 Your rights under the General Data Protection Regulation, in particular to compensation under Art. 82 GDPR, remain unaffected.

§ 11 Changes to these terms

11.1 We may amend these terms if there is a valid reason, for example new features, changes in the law or security requirements.

11.2 We will inform you of changes at least 14 days in advance by email or in the app.

11.3 Changes that put you in a worse position or affect the core of the Beta only apply if you actively accept them. If you do not accept, you can end your participation.

§ 12 Final provisions and contact

12.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another country, you keep the protection of the mandatory consumer protection provisions of that country.

12.2 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12.3 These terms are available in German and English. In case of any discrepancy, the German version prevails.

12.4 If any provision is invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory provisions.
